ZE BLOCKS x Some Fund Contest

OFFICIAL RULES

SKILL CONTEST. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. 


ELIGIBILITY:  To enter the Contest, you must be 21 years of age or older. The [ZE BLOCKS] Some Fund  Contest (the "Contest") is void in Cuba, Iran, North Korea, Russia, Syria, China, Crimea, Donetsk, and Luhansk, or any place where prohibited or restricted by law for any reason (“Prohibited Jurisdictions”).   Employees, officers, or directors of [ZE BLOCKS]. (“Sponsor”) or any of its parents, subsidiaries, affiliates, or any advertising or promotion agencies involved in this Contest (collectively, the “Contest Entities”), as well as the immediate family (children, siblings, and parents) and household members of each such person, are not eligible to participate. This Contest is subject to all applicable federal, state, and local laws and regulations. Void in the Prohibited Jurisdictions and where otherwise prohibited. 


CONTEST PERIOD:  The Contest begins on November 7th, 2023  at 2:00 p.m. U.S. Eastern Time (“ET”), and ends on Feb 5th, 2024 at 11:59 p.m. ET (the “Contest Period”).  


HOW TO ENTER:  During the Contest Period: (1) visit [somefund.xyz] (“Website”), (2) follow the on-screen instructions to complete the entry form with a written essay of at least [150] words in English explaining your idea and how you would use funds to implement your idea, and (3) upload a copy of [two (2)] samples of your recent work (“Submission”).  All required fields must be completed. Incomplete entries are void.

Limit one (1) entry per person/email address. Entrants are prohibited from using multiple names, accounts, email addresses, or any other means to enter more than once.  Any attempt to do so is grounds for disqualification. Use of any macro, bot, script or other automated means to submit entries is prohibited. Proof of posting is not proof of accessibility of the posting to Sponsor or anyone else. Sponsor's database computer is the official time-keeping device for the Contest. Entries will not be acknowledged or returned. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the authorized account holder of the email address associated with the entry. "Authorized account holder" is defined as the natural person who is assigned to an email address. 


SUBMISSION REQUIREMENTS: Submissions must include legible artwork, photos, and videos. Supported formats: JPG, PNG, GIF, MP3, WAV, AIFF, MOV, MPEG, MP4 & any downloadable file that does not exceed 500MB.

In addition, all Submissions must: (a) be the exclusive original work of the entrant; (b) be in keeping with the Sponsor’s image, (c) not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon the rights of any person or entity, including but not limited to copyright, trademark, privacy or publicity, (d) not contain any commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans, other than Sponsor’s, in a manner that could be deemed infringing; and (e) not depict any conduct or content that is unsafe, immoral, obscene or otherwise inappropriate as determined by Sponsor in its sole and absolute discretion. Each entrant further represents and warrants that it has permission from any and all recognizable persons depicted in a Submission and agrees, upon request, to furnish written proof of such permission.

Failure to meet any of the requirements above, or to otherwise comply with these Official Rules, may result in disqualification of you and your Submission. Sponsor reserves the right to delete or blur any inappropriate content from a submission without disqualifying the entry where, in Sponsor’s determination, such change does not materially alter the submission and the entrant has otherwise attempted in good faith to comply with these Official Rules.


PUBLICITY/USAGE RIGHTS: By entering, you warrant and represent that your Submission has been created by you as an original work and that all required third-party releases (if any) have been obtained in writing, and you further agree acknowledge and agree that Sponsor (and those acting with its authorization) may copy, reproduce, edit, broadcast and otherwise use your Submission in any way in any medium whether now existing or later discovered, worldwide, in perpetuity, including but not limited to posting online on Sponsor’s social media pages, without consideration to you.  

By entering, you warrant and represent that (i) all statements made in the submission process are true, accurate, and complete; (ii) the Submission has not been and will not be assigned or transferred to another party; (iii) no licenses to the Submission has or will be granted; (iv) the Submission is and will remain free from any and all other encumbrances of whatever kind or nature; (v) the Submission is unique to you  and was created solely by you  and no one else has any right, title, or interest in and to the submission and its contents (other than any co-submitters); and (vi) nothing in your Submission infringes or violates any patent, trademark, copyright, trade secret, or other right of any other party.

Except where prohibited, participation in the Contest and/or receipt or use of any prize further constitutes each winner’s consent for use of their name, likeness, voice, opinions, statements, biographical information, and/or hometown and state for promotional or advertising purposes in any media, worldwide, now known or hereafter developed, in perpetuity, without further review, notification, payment, or consideration (unless prohibited by law). 


JUDGING/WINNER SELECTION: Initial Judging: After the Contest Period, all eligible submissions during the Contest Period will be evaluated by judges using the following criteria: Creativity and Originality, Practicality of Implementation, Anticipated Effectiveness, and Benefit to the Community, to determine a maximum of up to 28 finalists to be posted on the Website for public voting. Fewer than 28 finalists may be selected in the event insufficient qualified entries are received. Judges' decisions are final and binding on all matters relating to the Contest.  

Public Voting:  From  12:01:00 a.m. ET on January 3, 2023, to 11:59 p.m. ET on February 5,  2024 (“Voting Period”), the public will have the opportunity to cast votes for their favorite ideas on the Website. Voting instructions will be available on the Website. Limit one (1) vote per person/email address. Use of script, macro, or any device to automate voting, hiring outsourced vote-farming services, paying for votes, or engaging in any other conduct deemed inappropriate, disruptive, or unsportsmanlike as determined by Sponsor in its discretion, is prohibited, and any entries or votes received through such means will be void. Any attempt by any voter or entrant to submit or solicit more than the stated number of votes by using multiple/different email addresses, identities, or any other method will void that person’s votes and entry (if any), and he/she may be disqualified from further voting or other participation in the Contest.

Winner Selection:  On or about February 9, 2024, the judges will select up to twenty-eight (28) winners per the chart in the “Prizes” rule applying the following criteria: Creativity and Originality, Practicality of Implementation, Anticipated Effectiveness, Benefit to the Community, and Public Appeal. Fewer than twenty-eight (28) winners may be selected in the event insufficient qualified entries are received.  Judges’ decisions are final and binding on all matters relating to the Contest. 

Potential winners will be notified using the contact information provided at the time of entry on or about February 9, 2024. No liability is assumed for any winner notification that is lost, intercepted or not received by a potential winner for any reason.  Failure to respond to any winner notification within three (3) days may result in disqualification and selection of an alternate winner. Potential winners may be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release.  Entry into this Contest constitutes an agreement to sign such documents.   If a potential winner fails to comply with Sponsor’s requests for any such documents, is found to be ineligible, or cannot or does not comply with these Official Rules, they may be disqualified and prize may be awarded to an alternate winner.  


PRIZES: Up to twenty-eight (28) prizes are available per the chart below. 

Fewer than twenty-eight (28) prizes may be awarded in the event insufficient qualified entries are received. Prize should be used to implement the winner’s idea as described in the Submission. Each prize will be awarded in the form of a check. Limit one (1) prize per person. Prize is non-transferable, and no prize substitution will be allowed. Sponsor may substitute a prize or prize component for one of equal or greater value if the advertised prize or component becomes unavailable.  Each winner is responsible for all taxes of any kind that may apply to the acceptance of a prize, including any withholding that may be required under any applicable laws. 


Prize Conditions:  Sponsor may conduct a background check to confirm eligibility and compliance with these rules.  By entering, you agree to cooperate reasonably with any such background check.  Failure to cooperate may result in disqualification and selection of an alternate winner.  If a potential winner has engaged in or does engage in any conduct that could damage the reputation or business of Sponsor, as determined by Sponsor in its discretion, the potential winner may be disqualified and the prize may be awarded to an alternate winner, time permitting.   Each winner must also comply with all requirements for proper and appropriate behavior during any prize-related activities or events. Any inappropriate behavior, as determined by Sponsor in its sole discretion, may result in removal from any activity or event.


PARTICIPATION: To the extent permitted by applicable law, by entering the Contest, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the Contest judges,  which are final and binding in all matters relating to the Contest; provided, however, that this does not affect the ability of any participant to pursue any available legal remedy. Entry materials/data that have been tampered with or altered are void. No responsibility is assumed, unless due to a breach of Sponsor’s obligations, for: (i) lost, late, misdirected, damaged, garbled, incomplete or illegible entries, all of which are void; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, mobile device, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems; or (iii) any injury or damage to entrant's or any other person's computer or mobile device related to or resulting from participating in the Contest. Sponsor reserves the right to: (i) permanently disqualify from any Contest it sponsors any person it believes has intentionally violated these Official Rules; and (ii) suspend, modify or terminate the Contest if Sponsor believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity or proper conduct of the Contest. If the Contest is terminated before the designated end date, Sponsor will (if possible) select winner from all eligible, non-suspect entries unaffected by the problem.    Any individual who is found to be tampering with the entry process or the operation of the Contest, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, may be disqualified, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.


RELEASE OF LIABILITY:  To the extent permitted by applicable law, by participating, you release Sponsor and its parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all others associated with the development and execution of this Contest from any and against  any and all injury, loss or damage caused or claimed to be caused by your participation in the Contest and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize except as expressly provided in these Official Rules.  Nothing in these Official Rules limits or excludes the liability of the Sponsor for fraud or for death or personal injury caused by the negligence of the Sponsor. To the extent permitted by applicable law, by participating, you agree that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney’s fees; (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses; and (d) these Rules and all disputes shall be governed by the internal laws of the state of Missouri, without regard to principles of conflicts of laws, any disputes shall be resolved exclusively in the state or federal courts in the state of Missouri, and you expressly consent to the jurisdiction of said courts and waive any objection thereto.  


DATA:  By entering, you agree to Sponsor’s manner of collection and usage of any personal information you submit, all of which is subject to Sponsor’s privacy policy located at somefund.xyz. 

WINNER LIST:   For the names of the winners, send an email to info@somefund.xyz..  All such requests must be received no later than 2/21/2024.
